1. The agreement
These terms ("Terms") form a binding agreement between you and highlinesx ("we", "us") governing your use of our website, web app, mobile apps and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
2. Account eligibility
- You must be at least 18 years old.
- You must provide accurate information when registering and keep your account credentials secure.
- You are responsible for all activity that happens under your account.
3. If you're a coach
highlinesx provides the tools; the coaching itself is between you and your client. By offering packages on the platform you agree that:
- You deliver the scope you advertise. Package descriptions must be honest and avoid overpromising outcomes.
- You are professionally qualified for the services you offer, and comply with the laws and licensing rules of your jurisdiction.
- You respond to clients within the response window you commit to.
- You do not provide medical diagnoses or treatment. If your work touches health or mental health, you operate within the scope of your qualifications.
4. If you're a client
- You provide accurate information about yourself so the coach can advise you appropriately.
- You pay the package price you sign up for, when due.
- You use the Service in good faith and do not abuse refund or dispute processes.
5. Payments, payouts and refunds
- Clients pay through our integrated payment processor at the point of subscribing to a package.
- Coach earnings are recorded in a wallet with two balances: pending (held until the per-session dispute window closes) and available (releasable to the coach).
- We may deduct platform fees and payment processing fees from each transaction. The breakdown is visible in the coach wallet.
- Refunds, when granted (e.g. as the outcome of a dispute), are issued back to the client's original payment method, less any non-recoverable fees.
6. Disputes
Either party may open a dispute within the dispute window that applies to a session or package. Once opened:
- The disputed earnings remain in the coach's pending balance until the dispute is resolved.
- Both sides may submit evidence (chat history, join timestamps, uploaded files).
- An administrator reviews the case and issues a decision — fund release, partial refund, or full refund.
- Admin decisions are final at the platform level. You retain whatever rights you have under applicable law.
7. Acceptable use
You will not use the Service to:
- Harass, threaten, defraud or abuse any other user;
- Upload illegal content, malware or material that infringes someone else's rights;
- Probe, scan or attempt to bypass platform security;
- Use automated means to scrape data or create fake accounts;
- Circumvent the platform by taking transactions off-platform after being matched through it.
8. Your content
You keep ownership of anything you upload — photos, videos, chat messages, profile copy, package descriptions. You grant us the licence we need to host, display and transmit your content as part of running the Service. You are responsible for making sure you have the right to share what you upload.
8.1 Community content and moderation
Parts of the Service — including the transformation feed and chat — display content created by users. We have no tolerance for objectionable content or abusive behaviour. By using the Service you agree that:
- You will not post content that is sexually explicit, hateful, harassing, violent, misleading, or that depicts another person without their consent.
- Before/after photos may only be published with the consent of the person shown, and captions must honestly describe the result.
- Anyone can report a specific piece of content from inside the apps. Reports are reviewed by our team, typically within 24 hours.
- We may remove or hide any content, and restrict, suspend or terminate the account of any user who posts objectionable content or abuses others, at our discretion and without prior notice.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded under applicable law. Coaching content shared through the platform is provided by independent coaches and is not medical, mental health, financial or legal advice. Always consult a qualified professional for those matters.
10. Limitation of liability
To the maximum extent permitted by law, highlinesx is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or business interruption. Our aggregate liability to you is capped at the amount you paid us in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.
11. Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate accounts that violate these Terms, with or without notice if the violation is material.
- Sections that by their nature should survive termination (payments owed, content licences, disclaimers, liability caps) will survive.
12. Changes
We may update these Terms from time to time. Material changes will be announced inside the app. Continued use of the Service after the update means you accept the new Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which highlinesx operates [to be specified by counsel — placeholder]. Disputes shall be resolved in the competent courts of that jurisdiction, unless local consumer protection law gives you a different right that cannot be waived.
